Administrative law

Orrick's Italian Administrative Law department has a deep experience in the main fields of law involving Italian public entities, both contentious and non-contentious.

Our professionals provide highly qualified assistance in the field of public procurements of works, supplies and services, either at domestic or European level. Our lawyers carry out the study of the legal framework, drafting of the documentation to be submitted in the bid processes, negotiation and drafting of the administrative law agreements, acting either for the contractors or the bidders.

The team comprises a group of litigators advising in the whole range of proceedings before the administrative courts, administrative authorities and independent regulatory agencies, in every instance and degree, due to a long-term experience of trials before the TAR, Consiglio di Stato, Court of Justice of the European Union, domestic and international arbitration panels, as well as before independent Authorities (e.g. Antitrust, Authority for the supervision of public contracts for works, services and supplies).

The Administrative Law department supports all the other practices of the firm when any public law issue arises, granting a fully integrated approach to clients in every transaction or litigation.

In out-of-court matters, the activity comprises the following topics:

public procurement or concessions of works and public services, including motorways, railways, air and sea transports, telecommunications, energy and water services (drafting calls and notices for bids, letters of invitation, tender offers, sub-contracts, specifications, general conditions);

  • project financings for the construction of infrastructures
  • environmental law, urban planning, expropriation procedures
  • management of all legal issues concerning the execution of public contracts.

Real estate law

Our Italian team includes lawyers with deep corporate real estate experience who advise clients active throughout the world in all phases of real estate investment, financing, development and construction. We act for a range of clients, including real estate advisors, real estate investment funds, public and private pension funds, investment banks and other financial institutions, real estate developers, insurance companies and other institutional investors, REITs and corporations.

Orrick attorneys deal with every type of acquisition and transfer of real estate, real estate financings, securitizations of commercial mortgage-backed securities, transactions on distressed assets connected to real estate, construction agreements, servicing agreements, asset management agreements, and leasing agreements.

The Italian real estate team also comprises of tax layers dealing with tax optimization of investments and related financial structures, both in terms of domestic and international taxation.
